These terms and conditions only apply if you are buying as a consumer. Currently we are not accepting any corporate/trade customer orders.
2. Your 100% Satisfaction Guaranteed
All the products sold by us are covered by our 100% satisfaction guarantee policy. We never want you be unhappy or lose faith in us. If for any reason you are not happy with your purchase from us, simply write to us and we are more than happy to provide you with a replacement or full refund, which ever you prefer.
3. Service Availability
Our website is only intended for use by people residing in the UK. We only accept orders from the UK mainland.
UK Mainland excludes, Northern Ireland, Eire, Scottish Highlands, Channel Islands and Isle of Man.
We reserve the right to not accept orders from elsewhere.
4. The Consumer [You]
The consumer [you] must be:
4.1 18 years old or above; * and
4.2 A resident of the UK mainland; and
4.3 Accessing our website from the UK; and
4.4 Legally capable of entering into a binding contract.
* If you are under the age of 18 you may use this website only with the involvement of your parents or guardian, but you can not place an order.
Some of our chocolate available for purchase on our website contain alcohol, by law we cannot sell alcoholic products to anyone under the age of 18. Additionally to process your order we may ask for a proof of ID. When placing an order for alcoholic products you are confirming that you are aged 18 or over.
5.1 The price of our product displayed on the website is the actual cost of the product except in the case of obvious error**.
5.2 The price of our products is inclusive of VAT (Currently 20%).
5.3 The price of the product excludes delivery charges. You are required to pay extra for the delivery charges, which is calculated at the checkout. For more details see the shipping and delivery page.
5.4 The price of our products are subject to changes at anytime, rest assured it will not effect orders which we have already sent you a confirmation of order acceptance email.
**We do our best to eliminate any typographical errors on our website, however, on some occasions incorrect prices for our products may be displayed on our website.
Please be advised that we are under no obligation to provide the product(s) to you at the lower price (the incorrect price) even if we have sent you a confirmation of order acceptance email for the product(s); where it is obvious the product is incorrectly priced.
- if the product’s actual price is less than the price displayed on our website, prior to dispatching the product, we will calculate the difference and refund the difference back to your PayPal account.
- If the product’s actual price is higher than the price displayed on our website, prior to dispatching the product, we will contact you via email and wait for your further instructions or cancel your order and inform you the reason for the cancelation of your order.
6. The Contract Between us and You
When you place an order to purchase our products on our website, your order constitutes an offer to us to buy a product from us. Do not assume that your order has been accepted. The contract between us and you will only become legally binding when you have made a full payment for your order and you have received an email from us confirming that your order has been accepted (confirmation of order acceptance).
The contract will only relate to the products mentioned in the confirmation of order acceptance email.
- Please be advised that we have made every effort to display our products as accurately as possible. Any photographs, descriptions, colours, specifications of the products displayed on our website are for illustration purposes only and to assist us with selling the products to you. They are only published to demonstrate to you the approximate idea of the products and they do not form as a part of contract between us and you.
- By placing an order, you are providing us with your up to date, complete, true and accurate details and the PayPal account used for making the payment is your own PayPal account.
7. Our Products and Allergens
All our products are made in the same environment as nuts and other allergens or may have been in contacts with nuts and other allergens. We do not guarantee they are nuts and allergens free. See the dietary information page for more details.
8. The Rights of Consumer
Other than our 100% satisfaction guaranteed policy; you are entitled to cancel your order within 7 (seven) working days commencing on the day after you received the products. You do not need to give us any reasons for cancelling your order. You should inform us your intention to cancel the order in writing and you must return the products to us immediately, in the same condition as you originally received, at your own cost and risk***.
In that case, we will then arrange a full refund for the price paid with in 30 days of which you received your order. See the refund policy (below) for more details.
*** Please be advised that once your order is placed, and the cost of the order including delivery charges are fully paid by you and the order is delivered to you then the ownership of the products will pass to you.
When the ownership of the product has passed to you, you have a legal obligation to take reasonable care of the products while they are in your position.
9. Refund Policy
Other than our 100% satisfaction guaranteed policy; should you decide to cancel your order within 7 (seven) working days commencing on the day after you received the products, Please take the following easy steps:
Step 1: You must write to us your intentions for cancelling your order immediately upon the delivery of the products.
Step 2: You should send all the products listed in that order back to us as soon as possible at your own cost and risk. We highly advise you to send the products back to us using a recorded mail delivery with insurance. We will not be liable for any damages or loss while the products are in transit to us.
Upon receiving the products and inspection, we will then arrange a refund due to you for the full cost of the product including the initial delivery charges. The full amount due for a refund will be transferred to the PayPal account initially used to make a payment for the order as soon as possible but no later than 30 days.
10. Cancellation by us
We reserve the right to cancel the contract between us and you. should we decide to cancel your order, we will inform you the reason for cancellation in writing via email. For any products you have paid for, we do our best to refund the amount, back to your PayPal account, as soon as possible but no later than 30 days.
We may cancel the contract between us and you if:
10.1 The product(s) you ordered are out of stock, in that case we will contact you to inform you of the next availability date or offer you a substitute product.
10.2 One or more of the products you order had been incorrectly priced due to a typographical error.
10.3 Your billing address is different to what PayPal has verified as your billing address.
10.4 We suspect that you are under 18 ordering product(s) containing alcohol.
11. Delivery of Products to Your Address
We will deliver the products (the order) to the address that you have provided us with, at the time of making the order. It is your responsibility to provide us with up to date and accurate delivery address details.
Should the delivery address be different to the billing/home address at the time of making the order, i.e. you are sending it to your work place or decide to leave the goods with a neighbour, this is done at your own risk.
Our delivery courier will require a signature from the recipient upon delivering the products(s), if for any reasons no one is present at the delivery address the delivery courier will then leave you a card, containing the address to a depot where you can go and collect your package(s).
- We do not provide specific day delivery in the UK.
- Currently we only ship to UK mainland.
- We do not ship to P.O. Box addresses.
12. Our Liability
Should you experience any of the followings:
12.1 Your order is lost; or
12.2 The products you ordered are damaged or defective; or
12.3 The products you order are of incorrect quantity; or
12.4 The product we delivered are not what you ordered.
You should inform us immediately in writing , our only obligation will be:
- To arrange delivery of non-delivered products; or
- To replace any products which were damaged or defective; or
- To make good any shortage; or
- To arrange a refund to you for the amount paid for the products in question.
We shall have no liability other than those stated above.
13. Your Use of Our Website
You are not allowed to use our website for any of the following reasons:
13.1 Spreading any objectionable materials or otherwise breaching any law.
13.2 Attempting to make the website unavailable for others.
14. Our Right to Cancel Your Registration
If you are in breach of any of the terms and conditions stated on this page, we have the rights to cancel you registration at our discretion without any notice. The cancellation of your registration or your rights to use this website shall not effect either party’s statutory rights.
15. Events Beyond our Control
We shall have no liability for:
15.1 Failure to deliver the products you have ordered; or
15.2 Any delay in delivering the products you have ordered; or
15.3 Any damages or defects to the products caused by events or circumstances which are beyond our reasonable control****.
****Events such as: Severe weather, fire, flood, earthquakes, impossibility to use private and public transport, industrial strikes, lockouts and others.
